  ENTRY - EXIT PROCEDURES IN Türkiye

Entry into and exit from Turkey is made through the border gates with a valid passport or passport substitute documents.  However, the Ministry of Internal Affairs is obliged to take the necessary measures to ensure that this general regulation is not implemented in a way that would prevent people from applying for international protection at the border gates.

What is meant by valid passports here are those issued in accordance with the procedures and principles in accordance with the Passport Law No. 5682. Documents that replace a passport are Passport, Administrative Letter, Seafarer's Wallet, Aircraft Crew Document, Railway Personnel Identity Document, Border Crossing Document, Travel Document, and Travel Document for Refugees. 

       Foreigners must show their passport or passport substitute document or documents to the officials when entering and exiting Turkey. These document checks can also be carried out at border crossings and while driving in vehicles. However, foreigners using transit areas of airports may be subject to control by the competent authorities. Essentially, the purpose of these checks is to determine whether the foreigner who wants to enter Turkey is within the scope of Article 7 of the Law on Foreigners and International Protection. If there is sufficient suspicion about the relevant foreigner while making this Article 7 determination, the following process will be initiated to perform a more detailed screening.

 COMPREHENSIVE CONTROL PROCEDURE AND PROCESS ON ENTRY TO THE COUNTRY

          As stated, in case of suspicion that the foreigner is one of the persons who will not be allowed to enter Turkey, a comprehensive control process is carried out by the law enforcement unit responsible for the entry procedures. The foreigner for whom a comprehensive control procedure is to be initiated must first and foremost be informed about the purpose and procedure of the control. It should be emphasized that the comprehensive control process is not an administrative surveillance process and is completed within 4 hours at most as required by law. However, time spent in judicial proceedings will not be included in this 4-hour period. If the authorized units foresee that the comprehensive control process will exceed 4 hours, except for judicial proceedings, the consent of the foreigner will be required. As a matter of fact, within the comprehensive control period, the foreigner can return to his country if he wishes, or he can wait for the procedures regarding admission to the country to be completed. 

          While the comprehensive control process is carried out, it is carried out in a separate place close to the passport control point, taking into account the security and personal privacy of the foreigner. However, the foreigner is provided with access to his basic needs during the control period. 

    - Scope of the comprehensive control process;

     1-  Control and examination of travel documents,

     2-  Reviewing the restrictions regarding entry records to the country,

     3-  Determining whether it is subject to action by judicial and administrative authorities,

     4-  Determining whether it is wanted at the international level,

     5-  Determining the purpose of coming to the country,

     6-  Clarifying how it will make a living in Turkey,

 7- It consists of investigating whether there are foreigners who will not be allowed to enter Turkey and foreigners who will not be granted a visa.

8- Other matters deemed necessary for public security. 

      Work and procedures regarding comprehensive control will be completed by the governorships to which the border gates are affiliated. The foreigner also has the right to receive legal services and legal support if needed during the comprehensive control process, and the right to take legal action regarding the subsequent decision to ban entry to Turkey regarding the foreigner is reserved.
