What is a Short-Term Residence Permit?
Short-term residence permit is one of the residence permit types regulated in the Foreigners Law and gives the right to stay in Turkey for up to 2 years or longer. It has more alternative options than other residence permit types. As a matter of fact, since the conditions are very broad, it allows people who meet many criteria to apply.
Who Can Get a Short-Term Residence Permit?
According to the relevant law, short-term residence permits can be given to the following foreigners:
a) Those who will come for scientific research,
b) Those who own real estate in Turkey. Those who are present,
c) They will establish commercial connections or business,
ç) They will participate in in-service training programs,
d) They will come for education or similar purposes within the framework of agreements or student exchange programs to which the Republic of Turkey is a party,
e) They will stay for tourism purposes,
f) They will receive treatment provided that they do not have one of the diseases that are considered a threat to public health,
g) Depending on the request or decision of the judicial or administrative authorities. Those who need to stay in Turkey,
ğ) Those who switch from family residence permit to short-term residence permit,
h) Those who will attend Turkish language learning courses,
ı) Those who will participate in education, research, internships and courses in Turkey through public institutions,
i) Those who have completed their higher education in Turkey and apply within six months from the date of graduation,
j) Those who do not work in Turkey but will invest in the scope and amount to be determined by the President. Those who will do so and their foreign spouse, and their spouse's minor or dependent foreign children,
k) Citizens of the Turkish Republic of Northern Cyprus are among these people.
What is the duration of a Short-Term Residence Permit?
As a general rule, a short-term residence permit can be issued for a maximum of two years at a time.
However, investors and their families within the scope to be determined by the President and Citizens of the Turkish Republic of Northern Cyprus are excluded from this general rule. Because; Residence permits for those who do not work in Turkey but will invest in the scope and amount to be determined by the President, their foreign spouses, their and their spouse's minor or dependent foreign children, and citizens of the Turkish Republic of Northern Cyprus can be issued for a maximum of five years.
On the other hand, residence permits for those who will attend Turkish language learning courses can be issued for a maximum of two times,
- . Residence permits for those who have completed their higher education in Turkey and apply within six months from the date of graduation are given once only for a maximum period of one year. In other words, it is not possible to renew every time it is requested.
What are the Conditions for Obtaining a Short-Term Residence Permit?
The following conditions are required for the issuance of short-term residence permits;
- Having one or more of the reasons for obtaining a short-term residence permit listed above,
- Making a request citing these justifications and submitting information and documents related to this request,
- Article 7 of the Foreigners Law. Not to be included in the scope of the application (i.e. not to be banned),
- To have housing conditions in accordance with general health and safety standards,
- If requested, to present a document showing the criminal record issued by the competent authorities of the country of which the person is a citizen or legally resident,
- To provide the address information where he/she will stay in Turkey.
Rejection, Cancellation or Rejection of Short-Term Residence Permit Not to be extended
First of all, we must say that since short-term residence permit is one of the other types of residence permit, almost all of the general rules apply here as well. On the other hand, in the following cases, specifically, a short-term residence permit is not granted; if it is granted, it is canceled and expired ones are not extended:
- One or more of the conditions for a short-term residence permit are not fulfilled or
disappeared,
- It is determined that the residence permit is used for purposes other than the purpose for which it was issued,
- There is a valid deportation or entry ban decision for the foreigner,
- Mandatory public These are cases of staying abroad for more than one hundred and twenty days in total in the last year, except for service, duty, education or health reasons.
- The decision to reject, cancel or not extend the residence permit application is notified to the foreigner or his legal representative or lawyer.
Residence Permits That Can Later Be Converted to Short-Term Residence Permit
1- At least Those who have stayed in Turkey for three years with a family residence permit and have completed the age of eighteen can convert their permit into a short-term residence permit if they wish, or apply for another type of residence permit for which they meet the conditions.
2- In case of divorce, a short-term residence permit can be granted to a foreigner married to a Turkish citizen, provided that they have stayed with a family residence permit for at least three years. The foreigner in question reserves the right to apply for another type of residence permit that meets the conditions.
3- A short-term residence permit may be granted to the foreign spouse on the grounds that he or she has been subjected to domestic violence, without the requirement of a three-year period, provided that the foreign spouse submits a court decision stating that he or she is the victim of this act.
4- In case of death of the sponsor, the family residence permit obtained under the sponsorship is used until the end of its period. Short-term residence permit can be granted without any duration requirement. At the end of this period, the foreigner's residence permit request is evaluated in accordance with the general provisions.
5- Until the work permit exemption confirmation certificate is issued by the Ministry of Labor and Social Security in accordance with Article 10 of the Law on Work Permits of Foreigners, foreigners listed in Article 55 of the Implementation Regulation of the Law on Work Permits of Foreigners and who come from foreign representatives with a visa suitable for their purposes are obliged to obtain a residence permit for up to ninety days, if their visa duration is sufficient. they are not kept. At the end of this period, a short-term residence permit is granted, provided that it is not longer than the right to work granted to them in accordance with Article 32 of the Law.
6- Foreigners who came to Turkey without obtaining a visa appropriate for their purpose, but who are understood to be within the scope of Article 55 of the Implementation Regulation of the Law on Work Permits for Foreigners, are granted a short-term residence permit by charging an entry visa fee upon request, regardless of whether they have come with a visa or visa exemption. is given.
